CONDITIONS GENERALES DE VENTE
Article 1 – Purpose
The General Conditions of Sale are applicable to all people who have placed an order on the site whose address is www.lescajousguillaume.com and government sales by SOTRACABE.
In the event that you place an order on our e-commerce site, you acknowledged having read and approved the content of these general conditions of sale and that you have no objection in this matter. However, if you disapprove of all or part of these General Terms and Conditions then cancel your order or refrain from any attempt to order on our site.
Article 2 – Price
The prices of our products are indicated in FCFA all taxes included « FCFA incl. VAT » (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
In the event of an order to a country other than Benin, you are the importer of the product or products concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not fall within the jurisdiction of SOTRACABE. They will be your responsibility and are your entire responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.
All orders regarding their origin are payable in FCFA. SOTRACABE reserves the right to modify its prices at any time, but the product will be invoked on the basis of the price in force at the time of validation of the order and subject to availability.
The products remain the property of SOTRACABE until full payment of the price.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products passes to you.

SOTRACABE reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
Article 4 – Validation of your order
Any order appearing on the website assumes adherence to these General Conditions. Any order confirmation details your full acceptance of these general conditions of sale, without exception or reservation.
All data provided and the recorded confirmation will constitute proof of the transaction.
You declare that you are fully aware of it.
Order confirmation and receipt of your payment will constitute signature and acceptance of the operations carried out.
A summary of your order information and these General Conditions will be communicated to you in PDF format via the email address confirming your order.
Article 5 – Payment
Payment is immediate and not subsequent.
Validating your order implies for you the obligation to pay the price indicated.
Payment for your purchases is only made via MTN Mobile Money or Moov Money, the procedure is explained on the website before validation of the purchase.
Article 6 – Withdrawal
The right of withdrawal does not require any reasons.
As the products are offered without a sealing system, they cannot be returned for reasons of hygiene or health protection after payment by the customer.
The withdrawal period corresponds to that between receipt of your payment and that of taking charge of the order by the customer or a third person mandated by the customer within the limit of 72 hours.
After this period, SOTRACABE reserves the right to reinstate the order in its stocks and keep 15% of the amount of your payment as management fees.
In the event of exercising the right of withdrawal, SOTRACABE will reimburse the sums paid, within 14 days following notification of your request and via the same means of payment as that used when ordering.
. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to:
The provision of services fully executed before the end of the withdrawal period and whose execution began after express prior agreement of the consumer and express waiver of his right of withdrawal.
The supply of goods made to the consumer’s specifications or clearly personalized.
Article 7-Availability
Our products are offered as long as they are visible on the site and while stocks last.
If a product is unavailable after placing your order, we will inform you by email /whatsapp before a short deadline. Your order will be automatically canced and we will ask for your instructions regarding a possible refund.
Article 8 – Delivery
The products are delivered either:
. at relay points selected by SOTRACABE
. to the address provided by the customer by La Poste, by GOZEM
. to the address provided by the customer and given to a trusted third party indicated by the customer. (a valid identity document of the customer will be requested upon collection or the identity document of the third party)
In the event of a shipping delay beyond our control, an email/telephone call will be sent to you to inform you of a possible consequence on the delivery time indicated to you.
In accordance with legal provisions, in the event of late delivery, you benefit from the possibility of canceling the order under the conditions and terms defined by article 6 above.
In the event of deliveries by a carrier, SOTRACABE cannot be held responsible for late delivery due exclusively to unavailability of the customer.

Article 10 – Guarantee
All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for in the following Civil Code. In the event of non-conformity of a product sold, it may be returned and exchanged. Supporting documents in the form of photos will then be requested and a finding by SOTRACABE staff will validate or not the non-conformity of the product.
All complaints, requests for exchange or refund must be made by telephone /by email /whatsapp within the time limit provided for in article 6 of these General Terms and Conditions.
All our products are rigorously controlled from the initial sorting of the white almonds to their packaging.
Article 11 – Responsibility
The products offered comply with current Beninese legislation. SOTRACABE cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities about the possibilities of importing or using the products or services you plan to order.
Furthermore, SOTRACABE cannot be held responsible for damage resulting from improper use of the product purchased.
Article 12 – Applicable law in the event of disputes
The language of this contract is French. These conditions of sale are subject to Beninese law. In the event of a dispute, the Beninese courts will have sole jurisdiction.
Article 13 – Intellectual property
All elements of the site are and remain the intellectual and exclusive property of SOTRACABE. No one is authorized to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written consent of SOTRACABE.

SOTRACABE reserves the right to collect nominative information and personal data concerning you. They are necessary for the management of your order, as well as for improving the services and information that we send to you.
They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

Article 15 – Archiving – Evidence
